Why Do I Need an Attorney After a Car Accident?

Car accident claims are usually more complicated than they seem at first glance. If you decide to handle your claim on your own, you risk skipping certain steps that can legally protect you, or else accidentally failing to follow the specific procedures that New York imposes on car accident claims.

In some situations, it may seem obvious which driver is at fault for a car accident. However, in almost all cases, the question of fault will remain unclear until the evidence and circumstances of the accident are thoroughly examined. You might not have every fact about the accident at your immediate disposal and, statements you might make to an insurance company may be inaccurate and harmful to your case.

In addition to these complications, if you are seriously injured after your car accident, the time you spend in the hospital can prevent you from being able to pursue a claim on your own. Even if your claim is successful, you may not obtain the full measure of compensation you deserve. For all of these reasons and more, having an experienced car accident attorney on your side can prove invaluable.

Presidential candidate Rick Santorum has recently surged in public opinion polls, causing some news organizations to take a closer look at positions he holds today and things he has said and done in the past.

One of his long-held positions is that medical malpractice law needs to be reformed, with a hard cap put in place on awards. However, back in 1999, he was apparently of a different mind when he testified in a chiropractic malpractice lawsuit brought by his wife, Karen, ABC News reports.

Working in a dangerous environment inevitably puts employees at risk. Fortunately, if you work in construction that requires you to work at an extreme elevation, you may know a little about New York's Scaffold Law. If you have been injured in a work-related accident, under New York Labor Law 240, you may be entitled to compensation. This law protects an employee that has been a victim of a work-related scaffolding injury, even if he or she contributed to the accident. While you may have the option of a workers' compensation claim when you are injured on the job, it is important to know that there are other options.

In a recent local story, the Occupational Safety and Health Administration (OSHA) charged a tile company for various safety violations. The Manhattan-based company was cited following a September accident. According to reports, an employee fell 80 feet from the top of a scaffold, which was around 120 feet high.

The members of the Suburban Hospital Alliance of New York State recently spent a couple of days lobbying state legislators in Albany on a number of issues, including their ongoing effort to get caps on medical malpractice damages.

As they did last year, hospital industry lobbyists are pushing for medical malpractice liability reform that they claim would result in lower insurance premiums for hospitals and doctors. But as we've noted in this space before, the real cost of these caps is borne by the people who can prove that they're the victims of medical malpractice.
